Terms of Service

1. General Provisions

These Terms of Service regulate the contractual relationship between Pink Kite LTD, registered at 8 Thorpe Road, Norwich, NR1 1RY, United Kingdom, and the client. By submitting a booking request and remitting the initial deposit, the client accepts these terms in their entirety. These conditions apply exclusively to travel itineraries organized within Australia and New Zealand.

2. Booking and Financial Obligations

To confirm a proposed itinerary, a non-refundable deposit of 30% of the total quoted cost is required. The remaining balance must be settled no later than 60 days prior to the scheduled date of departure. Failure to remit the balance within the specified timeframe may result in the unilateral cancellation of the itinerary by Pink Kite LTD, with the forfeit of the initial deposit.

All prices quoted are in British Pounds (GBP) unless explicitly stated otherwise. We reserve the right to adjust quoted prices prior to final payment to account for significant fluctuations in currency exchange rates or increases in transportation costs (e.g., fuel surcharges imposed by airlines).

3. Cancellation Policy

Cancellations initiated by the client must be communicated in writing to our corporate office. The following cancellation charges apply based on the proximity to the departure date:

  • More than 60 days prior: Loss of deposit.
  • Between 59 and 30 days prior: 50% of the total itinerary cost.
  • Less than 30 days prior: 100% of the total itinerary cost.

We strongly advise all clients to procure comprehensive travel insurance immediately upon booking to cover potential cancellation liabilities arising from unforeseen circumstances, including medical emergencies.

4. Alterations to the Itinerary

While Pink Kite LTD endeavors to execute all itineraries exactly as planned, operational necessities, severe weather events, or other forces beyond our control (Force Majeure) may necessitate alterations. If significant modifications are required prior to departure, we will notify the client and provide alternative arrangements of a comparable standard. We accept no liability for disruptions caused by third-party transportation providers (e.g., airline delays).

5. Liability and Indemnification

Pink Kite LTD acts as an agent on behalf of the client to secure services from independent contractors (hotels, airlines, transport operators, guides). We hold no direct liability for the acts, omissions, or negligence of these third parties resulting in personal injury, property damage, or delays, except where such incidents are the direct result of our own gross negligence or willful misconduct in the selection of these providers.

6. Governing Law and Jurisdiction

These Terms of Service and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from this agreement.
